Guardianship is one option when a person has significant problems managing financial affairs or personal care.  On occasion, it may be the only choice. However, it should be the last resort, for numerous reasons.   A Guardianship requires retaining an attorney and filing documents with the court, which can be time consuming, emotionally draining and costly. A Guardianship deprives a person of some or all of their personal rights.  Because of this, Texas law requires the Court to consider the availability of less restrictive alternatives that may be available.  Unfortunately, by the time a guardianship is necessary, many opportunities to utilize less restrictive alternatives may be lost due to the potential lack of capacity of the person to execute documents that would otherwise avoid or limit a guardianship. Anticipating the potential need of guardian in the future will provide the most options to avoid a formal guardianship.  However, even with no advanced planning, other alternatives may be available. Jeffrey Yates is a seasoned litigator and transactional attorney who focuses on probate and guardianships, litigation and estate planning.  He has served as an associate judge for the Collin County Probate Court, periodically presiding over the mental illness court. Jeff has been named to Law & Politics Magazine’s “Texas Super Lawyers Rising Stars” in 2005, 2009, 2010, and 2011, and “Texas Super Lawyers” in 2012, 2014, and 2015. Education: St. Mary’s University School of Law; Undergraduate: Texas A&M University.
