TRUST ISSUES IN DIVORCE PROCEEDINGS

DAVID JOHNSON

Sponsored by Lindquist Eisenberg, Plains Capital Bank and Regions Bank

Trust beneficiaries and settlors do get divorced, and this presentation will address many of the important implications for a trustee involved in that situation. This presentation will cover spouses creating an irrevocable trust, fraud claims to void a trust, conflict of interest issues raised by the same attorney drafting both spouse’s estate/trust documents, characterization of trust assets and distributions as separate or community, settlor standing to complain about trust administration issues, trust construction issues, adoption-in and adoption-out issues, spouse/settlor liability for controlling a trust, capacity issues raised by spouses being involved as trustees and director/officer of a closely held business, spouses’ co-trustee management issues, and the new Texas trust code provisions dealing with the effect of dissolution of marriage on certain transfers in trusts.  David Fowler Johnson (Winstead Law Firm) is widely recognized as one of the go-to fiduciary litigators in Texas. David’s practice focuses on trust, estate, and closely-held business disputes. A frequent writer and speaker, David is known around the state as a thought leader in the fiduciary area. His award-winning blog, Texas Fiduciary Litigator, features recent case law, legislative changes, and other precedent that impacts fiduciaries in Texas. David received the JD Supra 2020 Readers’ Choice Award for Wealth Management, which was his third year in a row for such an award. He was also named a “Go-To Thought Leader” in Fiduciary Litigation by the National Law Review in 2020.

There are continuing education credits pending for this meeting. The handout (if applicable) will be available on the website under the document library a few days prior to the presentation.
