ESTATE PLANNING CURRENT DEVELOPMENTS

Summary:  Estate planning under a new paradigm in light of legislative developments and other current developments; Estate, gift, and GST tax planning in light of legislative changes; transfer planning and creative ideas for making use of the increased $5 million gift exemption amount; discussion to include:  strategies for making the decision under new legislation of whether 2010 decedents are subject to estate tax or carryover basis; how to implement the modified carryover basis system for 2010 estates that choose to be subject to carryover basis to avoid estate tax, transfer planning strategies to take advantage of $5 million gift exemption; best strategies for utilizing valuation discounts and grantor trusts under the new paradigm of transfer planning.  Steve R. Akers, JD, is a Managing Director with Bessemer Trust Company, N.A., in Dallas, Texas, where he is Fiduciary Counsel for the Southwest Region and is in the Legacy Planning Department. Mr. Akers is a member of the Advisory Committee to the University of Miami Philip E. Heckerling Institute on Estate Planning and is a frequent speaker at that Institute, as well as other estate planning seminars across the country. He is a past Chair of the American Bar Association’s Section of Real Property, Trust & Estate Law and continues to serve on various committees of that Section.  He is a Fellow of the American College of Trust and Estate Counsel, and currently serves a Regent, the Editor of the ACTE Journal, and a member of the ACTEC Long Range Planning Committee.  He is a past Chair of the State Bar of Texas Real Estate, Probate and Trust Law Section and of the Dallas Bar Probate, Trusts and Estates Section.  He is a co-author of A Planning Guide to Buy-Sell Agreements.
