WILL CONTESTS

ELLIOTT BURDETTE, MARK CALDWELL AND BRIAN THOMAS

This presentation will discuss the following issues pertaining to will contests: 1) circumstances in which clients think they have a valid will, but actually don’t; 2) Examples of what does and does not constitute undue influence in the State of Texas; 3) Discussion of situations that involve a lack of capacity; 4) Discussion of situations where wills are invalidated because they were not executed properly; 5) A general discussion of some of the steps that can be taken to minimize the successful will contest; and 6) A discussion of what causes life insurance to be part of the decedent’s probate estate and therefore subject to a will contest. Elliott E. Burdette received a JD degree from the Southern Methodist School of Law.  Since 1982, he has practiced law in the North Texas area with an emphasis on trust, estate, probate and related litigation.  He is the principal in the four lawyer probate litigation firm of Burdette & Rice, P.L.L.C.  Mark Caldwell worked as a probate litigator since graduating from law school until he joined Burdette & Rice in 2010. He received his law degree from New England Law Boston.  Caldwell leads an ongoing probate study group attended by fellow probate lawyers and court staff.  Brian Thomas, Burdette & Rice, received his JD from Baylor University and is an active member of the Dallas Association of Young Lawyers. He has spoken extensively on probate matters to a variety of professional and community groups.

ALL OTHER WALK-INS WILL BE “PROGRAM ONLY”.  Members who have already paid in advance for all meetings for the year MUST register (you can send an e-mail to northtexasepc@yahoo.com) so we will have a count for the number of meals to prepare and number of outlines to print.
