Unfortunately, our clients frequently have difficulty in convincing third parties to accept their powers of attorney, and in some cases, our client’s incapacity may limit available remedies when the problem arises. This presentation will explore the reasons why powers of attorney are not accepted by third parties, practical drafting suggestions to make powers of attorney more acceptable to third parties (including possible modifications to the statutory form), and special issues related to use of powers of attorney. The presentation will also discuss whether and to what extent the use of a revocable trust as the primary dispositive vehicle can eliminate the need to use (or the problems associated with using) a durable power of attorney. Don Totusek is a partner in the Dallas firm of Francis, Orr & Totusek, L.L.P. Don’s practice is primarily focused on estate planning, probate, and related matters and he is Board Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization. Don also practices banking law, with his banking practice limited to issues affecting the deposit side of financial institutions. While he answers day-to-day questions for several banks, much of his banking practice is educational in nature, as he regularly presents seminars for bank personnel. Don is a regular speaker on various topics relating to estate planning and probate and the deposit side of financial institutions. Don is the author of the Account Documentation Manual, a publication used by many Texas bankers as a resource.
