HANDLING MINERAL INTERESTS IN ESTATES AND PROBATE

As the oil and gas field has developed in the last twenty years, the wealth transfer associated with long-held mineral interests being devised to new generations has created a knowledge vacuum in how to locate, value and transfer mineral interests as part of the estate planning and probate process.  This presentation will present a basic understanding of how to ensure this class of assets are preserved through the estate planning and probate process. A final discussion will be directed to the importance of providing clients with information for long-term management options and the importance of reviewing with those serving as fiduciaries the need to review and implement minimum protections before estate transfers occur of record, whether through recorded probates or via estate distribution deeds to beneficiaries. Mineral interests have long been deemed a source of generational wealth and great care has been taken by prior generations to ensure that they pass to future generations without loss. Virginia A. Moore has had a varied career coupled with a lifetime of experience in the field of oil and gas.  She is an honors’ graduate of the University of Houston Bates College of Law where she tailored her studies around oil and gas and environmental law, clerking for Keith Blinn, then General Counsel of Conoco Oil Company and Adjunct Professor of Oil and Gas Law. She has had her own firm for many years and since the advent of the Barnett Shale, her practice has been dominated by oil and gas law, representing hundreds of mineral and royalty owners, individually and in groups, in lease negotiations and other matters.  For the last ten years, Ms. Moore’s practice has also had a primary focus on assisting clients in locating, identifying, transferring and valuing mineral estates as part of probate and trust transactions.
