NEW LAW INCOME TAX ISSUES

The Obamacare surtax now applies to much, if not most, accumulated income of trusts and estates.  At the beginning of this year, we also got a new tax bill, and for the first time in more than a decade the tax law doesn’t have sunset provisions.  Top marginal income tax rates are now higher than the estate taxes, if not gift taxes, if these taxes apply at law.  This presentation will be an exploration of this strange, new world. The presentation will discuss the rules that apply to the Obamacare income tax surtax as they relate to trusts and estates.  It will also consider the interplay of income taxes and transfer taxes in view of the changes in the relative rates and the limited application of the estate and gift tax due to dramatically higher exemptions.  Other recent income tax issues that related to trusts and estates will also be discussed.  Mr. Lindquist has represented major bank trust departments, very wealthy individuals, family business owners and many individuals who simply wanted to be sure that their assets would benefit their families and charities to the greatest extent possible. Working for 20 years with individuals on their trust and estate-related issues taught Mr. Lindquist the importance of listening to each client and developing an approach that is right for them.  Mr. Lindquist has been Board Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization.  He received his JD from University of Texas School of Law.
