ESTATE PLANNING FOR OIL AND GAS OWNERS

With the expansion of oil and gas exploration, more and more people are finding themselves bearing the title of “oil and gas owner.”  The wealth that can be generated as a result of these oil and gas activities can often be staggering.  Accordingly, it is important for the estate planning professional to understand oil and gas as an asset, its unique characteristics, and the tax and non-tax considerations associated with the ownership, development, transfer and valuation of oil and gas properties.  This presentation will provide an overview of oil and gas as a financial asset, the unique income tax issues applicable to oil and gas interests, the manner in which these unique assets can be incorporated into common estate planning vehicles (such as grantor retained annuity trusts, installment sales to grantor trusts and charitable trusts) and the fiduciary issues that can arise by virtue of oil and gas interests being in managed in trusts and estates. Derek L. Fletcher is a Managing Director and Wealth Strategist at U.S. Trust, Bank of America Private Wealth Management in Dallas, Texas.  Derek is a Certified Public Accountant, a Fellow of the American College of Trust and Estate Counsel and is board certified in estate planning and probate law by the Texas Board of Legal Specialization.  Derek is the Chairman of the Estate and Gift Tax Committee of the American Bar Association Tax Section, Former Chairman of the Dallas Bar Association Probate, Trust and Estates Section, and a Former Member of the Board of Governors of the Dallas Estate Planning Council.  Derek has spoken at numerous tax and estate planning seminars on a variety of sophisticated wealth transfer topics.  Derek earned his BBA in Accounting from Texas Tech University and his JD from the University of Texas School of Law. 

Continuing education credits are pending for this program.
