ESTATE PLANNING AND LITIGATION ISSUES

DIANNE REIS AND ED RICE

Estate planning strategies that work well in harmonious families can become problematic if the family develops conflict.  Powers of attorney, discretionary trusts, and other arrangements that provide flexibility and reduce costs can lead to costly litigation.  The presenters will discuss several estate planning tools, first from a planner's view, and then from a litigator's view.  Dianne Reis has an estate planning and probate practice in Plano, Texas, which includes estate tax, guardianship and Medicaid planning.  She is Board Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization, Certified in Elder law by the National Elder Law Foundation and the author of Texas Estate Planning, published by James Publishing Company.    She received her J.D. with Honors from the University of Texas School of Law and an A.B. in Economics from Harvard University. She is a frequent speaker to attorneys and other professionals in her area of expertise.  Edward L. Rice, partner, Burdette & Rice, received his Bachelor’s Degree in Economics from Texas A&M, then spent two years under the tutelage of his father, an MBA, in the family’s small business. He went on to law school at the University of Houston.  Upon graduation, Ed accepted an invitation to serve as a briefing attorney for the Chief Justice at the 14th Court of Appeals in Houston. He then entered private practice as a litigator in a large San Antonio firm, representing large corporations in both Federal and State trial and appellate courts. Moving to Dallas in 1995, and continuing to practice in the trial courts and handling appeals, Ed concluded that the most rewarding work for him was representing individuals and small businesses like the family business he had left. Ed began to work with Burdette & Rice in 2002, and his past knowledge and experience in small business, as both participant and advocate, has proved invaluable. His primary practice areas are fiduciary and probate litigation, and his experience with individual and business transactions, and appellate law, provide essential skills as family businesses pass to the next generation.
