Estate planning professionals have witnessed numerous changes in the last fifteen years, including the rapid rise of the estate and gift tax exclusion amount, the introduction of portability and basis consistency reporting requirements, and the SECURE Act and SECURE Act 2.0, to name a few. One of the few constants has been the marital deduction, which generally allows spouses to transfer unlimited amounts of property to one another, whether during life or upon death, on a tax-free basis. This presentation will provide an overview of familiar marital deduction planning concepts in order to examine how to most effectively deploy them in the current estate planning environment. In particular, she will discuss general power of appointment trusts and QTIP trusts and the advantages and disadvantages of each technique. She will also highlight some of the less common ways to qualify for the marital deduction and explore how and when using an unconventional approach may be beneficial. Lastly, she will cover the estate tax reporting requirements for various marital deduction planning techniques and other taxation issues that may arise during the lifetime or upon the death of the surviving spouse.

Shannon A. Weber is an associate attorney at Davis Stephenson, PLLC. She assists in representing and counseling high net worth individuals and multi-generational families in achieving their unique estate planning and charitable objectives. This includes drafting a variety of sophisticated estate planning documents, considering transfer tax and marital property issues, advising on trust creation and administration, drafting marital property agreements, and handling estate administration and probate matters. What Shannon enjoys most about her estate planning practice is the opportunity to work closely with clients to understand their family dynamics, values, and unique objectives. She takes pride in being responsive, understanding, and thorough when working with clients and other advisors.
