The presentation discusses the use of 678 trusts in estate planning, focusing on their tax implications, practical considerations regarding when they might be helpful, and how they might best be designed. It explains the basics of 678 trusts, their different types and structures, and their potential advantages and disadvantages. It covers the differences between 678 trusts and their better-known sibling known as the “grantor trust”, with an emphasis on whether and to what extent the various types of 678 trusts might enjoy the popular tax benefits afforded to grantor trusts. Special attention is given to the “BDIT” and the “BDOT” – two types of 678 trusts that have recently risen in prominence and have unique complexities and risks. Ultimately, the presentation aims to provide practical ways to navigate the issues inherent in the various types of 678 trusts and incorporate them effectively into one’s own practice.
Toby Eisenberg is a partner at Lindquist Eisenberg LLP, a boutique trusts and estates law firm located in Plano, Texas. Toby’s practice is focused on helping high net worth clients with the preservation and efficient transfer of their wealth during lifetime and upon death. He is board certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization and is a Fellow of The American College of Trust and Estate Counsel. He has served as the President of the Dallas Estate Planning Council and as a member of the Board of Directors for the Dallas Bar Association Probate, Trusts, and Estates Section. Toby holds a J.D. from The University of Texas School of Law, a Ph.D. in Religious Studies from Southern Methodist University, an M.A. in Biblical Studies and Theology from Fuller Theological Seminary, and a B.A. in Philosophy from Rice University.
